KakuremiTerms of Service

These Terms of Service ("Terms") govern your use of Kakuremi, a KeePass-compatible password manager for iOS developed by SpringHiker Inc. ("we," "us"). By installing or using Kakuremi, you agree to these Terms.
1. License Grant
Subject to your compliance with these Terms and Apple's Licensed Application End User License Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Kakuremi on Apple-branded devices that you own or control. This license is granted on a per-user basis and permits use for both private and business purposes (including use by sole proprietors and use in the course of employment), provided each user obtains their own license.
2. User Responsibilities
Kakuremi is a tool you operate. You are solely responsible for:
- Master password management. You must remember and protect your master password. We cannot recover, reset, or bypass it under any circumstances.
- Backup. You must maintain your own backups of your KeePass database (.kdbx) files. We do not store, sync, or back up your data.
- Hardware key management. If you use a YubiKey or other hardware security key, you are responsible for safekeeping it. Loss of the key may result in permanent loss of access to your database.
- Lawful use. You will not use Kakuremi for any unlawful purpose or in violation of any applicable law.
- Device security. Maintaining the security of your device (passcode, biometric enrollment, OS updates) is your responsibility.
3. Data Loss Acknowledgement
Important: KeePass databases use industry-standard cryptography. If you forget your master password, lose your key file, or lose your YubiKey, your data cannot be recovered — by us, by Apple, or by anyone else. This is a feature of the security model, not a defect.
You acknowledge and accept this risk before using Kakuremi.
4. Disclaimer of Warranties
KAKUREMI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
We do not warrant that Kakuremi will meet your specific requirements, that any data stored or accessed through Kakuremi will be preserved without loss or corruption, or that defects will be corrected.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPRINGHIKER INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF KAKUREMI.
Our total cumulative liability for any claim arising out of or related to Kakuremi will not exceed the greater of (a) the amount you paid us for the app and in-app purchases in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $50.
Nothing in these Terms limits liability that cannot be limited under applicable law. For consumers in Japan, this includes liability arising from our willful misconduct or gross negligence, which is not excluded or limited by these Terms.
6. Third-Party Services
In-app purchases are processed by Apple StoreKit and governed by Apple's terms. We are not responsible for the operation of Apple's services. Refunds for in-app purchases are handled by Apple in accordance with their refund policy.
7. Updates to Kakuremi
We may release updates to Kakuremi from time to time. We do not guarantee continuous availability of any specific version or feature. New versions may modify or remove functionality.
8. Termination
You may stop using Kakuremi at any time by uninstalling the app. We may suspend or terminate your license if you materially breach these Terms. Sections 2 through 6, 9, and 10 survive termination.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or Kakuremi will be subject to the exclusive jurisdiction of the Tokyo District Court (東京地方裁判所) as the court of first instance.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Effective" date at the top of this page. Continued use of Kakuremi after changes become effective constitutes acceptance.

本利用規約（以下「本規約」）は、スプリングハイカー株式会社（以下「当社」）が提供する KeePass 互換 iOS パスワードマネージャー「Kakuremi」の利用条件を定めるものです。本アプリのインストールまたは利用により、お客様は本規約に同意したものとみなされます。
1. ライセンス
本規約および Apple の ライセンス済みアプリケーションエンドユーザー使用許諾契約に従うことを条件として、当社はお客様に対し、お客様が所有または管理する Apple ブランド端末上で Kakuremi をインストールおよび利用する、個人的・非独占的・譲渡不可・取消可能な権利を許諾します。本ライセンスは 1 ユーザー単位で付与されるものであり、私的利用のほか、業務目的での利用（個人事業や法人の業務における各ユーザー自身の利用を含みます）も許諾の範囲に含まれます。
2. お客様の責任
Kakuremi はお客様自身が操作するツールです。以下についてはお客様の単独責任となります：
- マスターパスワードの管理。お客様はマスターパスワードを記憶し、適切に管理する必要があります。当社はいかなる事情があってもマスターパスワードを復元・リセット・回避することはできません。
- バックアップ。KeePass データベース（.kdbx）ファイルのバックアップはお客様自身で実施してください。当社はお客様のデータを保存・同期・バックアップしません。
- ハードウェアキーの管理。YubiKey 等のハードウェアセキュリティキーをご利用の場合、その保管はお客様の責任です。キーの紛失によりデータベースへのアクセスが永久に失われる可能性があります。
- 適法な利用。Kakuremi を違法な目的または適用法令に違反する形で利用してはなりません。
- 端末のセキュリティ。端末のパスコード設定・生体認証登録・OS アップデート等、端末セキュリティの維持はお客様の責任です。
3. データ消失に関する確認事項
重要：KeePass データベースは業界標準の暗号方式を採用しています。マスターパスワードを忘れた場合、キーファイルを紛失した場合、または YubiKey を紛失した場合、当社・Apple・その他いかなる第三者によってもデータを復元することはできません。これは欠陥ではなく、セキュリティモデル上の仕様です。
Kakuremi の利用開始前に、お客様はこのリスクを理解し受け入れたものとみなされます。
4. 保証の否認
Kakuremi は「現状有姿（AS IS）」かつ「提供可能な状態（AS AVAILABLE）」で提供され、明示・黙示を問わずいかなる保証も付されません。適用法令で許容される最大限の範囲において、当社は商品性・特定目的への適合性・第三者の権利を侵害しないこと、およびアプリにエラー・中断・セキュリティ上の欠陥がないことを含む、あらゆる保証を否認します。
当社は、Kakuremi がお客様の特定の要件を満たすこと、保存・アクセスされるデータが消失または破損なく保持されること、不具合が修正されることを保証しません。
5. 責任の制限
適用法令で許容される最大限の範囲において、当社は Kakuremi の利用に関連して生じた間接的・付随的・特別・結果的・懲罰的損害、ならびにデータ・利益・収益・信用の損失について、一切の責任を負いません。
Kakuremi に関連するあらゆる請求についての当社の累積的な総責任額は、（a）当該請求の原因となった事象発生前 12 ヶ月間にお客様が当社に支払ったアプリ代金および App 内課金合計額、または（b）50 米ドル相当額のいずれか高い方を上限とします。
本規約のいかなる条項も、適用法令により制限できない責任を制限するものではありません。日本の消費者については、当社の故意または重大な過失に起因する責任は本規約による免除・制限の対象外です（消費者契約法 第 8 条）。
6. 第三者サービス
App 内課金は Apple StoreKit により処理され、Apple の規約に従います。Apple のサービスの運営について当社は責任を負いません。App 内課金の払い戻しは Apple の返金ポリシーに従い Apple が処理します。
7. Kakuremi のアップデート
当社は随時 Kakuremi のアップデートをリリースする場合があります。特定のバージョンや機能の継続的な提供を保証するものではありません。新バージョンにより機能が変更・削除される可能性があります。
8. 終了
お客様はアプリをアンインストールすることで、いつでも Kakuremi の利用を終了できます。お客様が本規約に重大な違反をした場合、当社はライセンスを停止または終了することができます。第 2 条から第 6 条、第 9 条、第 10 条は終了後も存続します。
9. 準拠法・裁判管轄
本規約は、抵触法の原則にかかわらず、日本法に準拠して解釈されます。本規約または Kakuremi に関連して生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
10. 本規約の変更
当社は随時本規約を変更する場合があります。重要な変更については本ページ上部の「施行日」を更新することで反映します。変更の施行後も Kakuremi の利用を継続した場合、変更内容に同意したものとみなされます。

本服务条款（"本条款"）适用于由 SpringHiker Inc.（"我们"）开发的 KeePass 兼容 iOS 密码管理器 Kakuremi。安装或使用 Kakuremi 即表示您同意本条款。
1. 许可授予
在您遵守本条款及 Apple 的已许可应用程序最终用户许可协议的前提下，我们授予您在您拥有或控制的 Apple 品牌设备上安装和使用 Kakuremi 的个人、非独占、不可转让、可撤销的许可。本许可以每位用户为单位授予；除个人用途外，亦允许用于业务目的（包括个体经营者的经营活动及企业内部各用户自身的使用）。
2. 用户责任
Kakuremi 是由您自行操作的工具。以下事项由您独立承担责任：
- 主密码管理。您必须自行记忆并妥善保管主密码。在任何情况下，我们都无法恢复、重置或绕过您的主密码。
- 备份。您必须自行备份 KeePass 数据库（.kdbx）文件。我们不存储、同步或备份您的数据。
- 硬件密钥管理。如使用 YubiKey 或其他硬件安全密钥，由您负责保管。密钥丢失可能导致数据库访问权限永久丧失。
- 合法使用。您不得将 Kakuremi 用于任何非法目的或违反适用法律。
- 设备安全。维护设备安全（密码、生物识别注册、系统更新等）由您自行负责。
3. 数据丢失风险确认
重要：KeePass 数据库采用业界标准的加密技术。如您遗忘主密码、丢失密钥文件或丢失 YubiKey，我们、Apple 及任何第三方均无法恢复您的数据。这是安全模型的设计特性，并非缺陷。
使用 Kakuremi 前，您确认理解并接受此风险。
4. 免责声明
Kakuremi 按"现状"和"可用状态"提供，不附带任何明示或暗示的保证。在适用法律允许的最大范围内，我们否认所有保证，包括但不限于适销性、特定用途适用性、不侵权，以及应用程序无错误、不中断或安全的保证。
我们不保证 Kakuremi 满足您的特定需求、所存储或访问的数据不丢失或损坏，或缺陷将得到修复。
5. 责任限制
在适用法律允许的最大范围内，对于因使用 Kakuremi 而产生的任何间接、附带、特殊、后果性或惩罚性损害，以及任何数据、利润、收入或商誉的损失，SpringHiker Inc. 概不负责。
我们对与 Kakuremi 相关的任何索赔的累计总责任不超过以下两者中较高者：（a）索赔事件发生前十二（12）个月内您向我们支付的应用程序及应用内购买款项总额，或（b）50 美元。
本条款不限制适用法律不允许限制的责任。
6. 第三方服务
应用内购买由 Apple StoreKit 处理并受 Apple 条款约束。我们不对 Apple 服务的运营负责。应用内购买的退款由 Apple 根据其退款政策处理。
7. Kakuremi 更新
我们可能不定期发布 Kakuremi 的更新。我们不保证持续提供任何特定版本或功能。新版本可能修改或移除功能。
8. 终止
您可以随时通过卸载应用程序停止使用 Kakuremi。如您实质性违反本条款，我们可暂停或终止您的许可。第 2 至 6 条、第 9 条及第 10 条在终止后仍继续有效。
9. 适用法律与管辖
本条款适用日本法律，不考虑法律冲突原则。因本条款或 Kakuremi 引起或与之相关的任何争议，应由东京地方法院（東京地方裁判所）作为第一审专属管辖法院。
10. 条款变更
我们可不定期更新本条款。重大变更将通过更新本页顶部的"生效日期"反映。条款变更生效后您继续使用 Kakuremi 即视为接受变更。
